ADA, North Carolina Dental board claim SCOTUS ruling undermines professional boards' authority

Last week, the U.S. Supreme Court ruled against the North Carolina licensing board in a case focused on what providers are allowed to offer teeth whitening services. The North Carolina State Board of Dental Examiners and American Dental Association have spoken out against the decision, according to a Dr. Bicuspid report.

The ADA and North Carolina board argue that the decision undermines the authority of state and professional boards.

The Supreme Court ruled six to three against the state board in the North Carolina State Board of Dental Examiners vs. Federal Trade Commission. A state board is not normally subject to federal antitrust laws, but the North Carolina board is not subject to active state supervision. Thus, the board does not have immunity, according to the report.
