In a putative class action lawsuit against Nashville-based SmileDirectClub, local orthodontists and consumers allege that the company committed fraud and misled buyers, Nashville Post reports.
The complaint, filed in federal court Sept. 25, alleges that SmileDirectClub's marketing was fraudulent and misleading for product users. The orthodontists are seeking damages for lost profits, claiming the company has undercut their business.
"SmileDirectClub cannot comment on the case as we are in a quiet period post-IPO until early October," a spokesperson told Nashville Post.
The complaint comes after Gov. Bill Lee announced plans to incentivize the company's continuous expansion in Tennessee.
Since SmileDirectClub shares went public Sept. 12, and they have lost value quickly.
